The caseworker enters the following, as in any other conservatorship case:

  • Original petition
  • Affidavit
  • Court orders

DFPS can be granted temporary managing conservatorship for the purpose of protective foster care. The adoptive family can be named temporary joint managing conservators if:

  • The family is willing.
  • Joint managing conservatorship is in the best interest of the child.
  • It is approved by the court.

After temporary or joint managing conservatorship is granted to DFPS, DFPS manages the case as any other conservatorship case, with all the same time frames and expectations.

Staff should understand the different issues associated between the child and adoptive family that are unique to that type of parent-child relationship, and different from birth parent histories and issues. If further clarification is needed, contact the Post Adoption regional liaisons.
