Certain specific conduct is grounds for termination of parental rights when it does both of the following:

  • Causes death or serious injury to a child or adult.
  • Results in criminal or delinquency proceedings against the perpetrator.

This includes criminal conduct committed in another jurisdiction that contains elements substantially similar to the conduct listed below.

The specific conduct includes:

  • Murder or manslaughter.
  • Certain sexual crimes.
  • Assault.
  • Injury to a child.
  • Injury to a person who is elderly or disabled.
  • Child abandonment or endangerment.
  • Child trafficking.

Other related grounds for termination are:

  • Knowingly engaging in criminal conduct that results in imprisonment for at least two years from the date of the filing of the petition, along with proof of an inability to care for the child.
  • Conviction for the murder, attempted murder, or solicitation of murder of a child’s other parent.
  • Conviction for the criminal or online solicitation of a minor.
